Welcome to Endo45 a mobile app and website, designed to help manage your health or people you are caring for who may suffer from endometriosis. The App and website provide a way to take control and manage health information associated with endometriosis.

Endo45 understands your concerns about privacy and your interest in knowing how your information is used and shared, and so we have created this Privacy Policy (the “Privacy Policy”) to provide you with more information on these topics.

We regret that if there are one or more points below with which you are not happy, your only recourse is to leave our website and App immediately.

This privacy policy has been compiled to better serve those who are concerned with how their 'Personally Identifiable Information' (PII) is being used online. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website and Application.

This Privacy Policy describes the practices, policies and procedures for our website www.endo45.co.nz (the ‘website) and Application (Endo45) referred to as the ‘App’. Endo45 aims to inform you about how we collect and handle any information that we collect from you, or that you provide to us. It covers both information that could identify you (“personal information”) and information that could not.

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

  2. For a secondary purpose that is directly related to the primary purpose

We understand that all users of our website and App are quite rightly concerned to know that their data will not be used for any purpose unintended by them and will not accidentally fall into the hands of a third party. Our policy is both specific and strict. It complies with New Zealand law and with the laws of all jurisdictions of which we are aware. Endo45 is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

We may update this Privacy Policy from time to time, so please check this Privacy Policy periodically for changes.

Here is a list of the information we collect from you, either through our website or App or because you give it to us in some other way, and why it is necessary to collect it:

Business and personal information

This includes basic identification and contact information, such as your name (nickname) and contact details (email address) and also includes all information given to us in the course of your business and ours, such as information you give us in your capacity as our user/client. We undertake to preserve the confidentiality of the information and of the terms of our relationship. It is not used for any other purpose. We expect you to reciprocate this policy.

This information is used:

  1. to provide you with the services which you request;
  2. for verifying your identity for security purposes;
  3. for marketing our services and products;
  4. information which does not identify any individual may be used in a general way by us or third parties, to provide class information, for example relating to demographics or usage of a particular page or service.

Email Newsletter: If you opt to receive our newsletter, we will ask you to provide certain personally identifying information, including your email address, first and last name. You may unsubscribe from these emails at any time by using the link provided in the footer of all such emails.

Contact Us: The Website provides “contact us” links for questions visitors may have about the work we do, our App and our Website. If you contact us through any of these contact forms, we will collect your email address and any other personal information that you provide to us. We will use the information you provide to contact you and to respond to any requests and/or questions.

We keep information, which forms part of our business record for a minimum of seven years. That is because we may need it in some way to support a claim or defence in court. That is also the period within which our tax collecting authorities may demand to know it.

Non-Personal Information automatically collected

We also collect certain non-personal information (data in a form that does not support a direct association with any specific person or individual) by automated means when you visit the Website and download the App. Much of this information is collected through the use of third-party tracking services, which includes Apple, website analytics, and Google Analytics etc. The information collected may include usage information, such as the numbers and frequency of users to the App Store, Google PlayConsole, Website, App, pages visited, web browsing histories, online purchases and searches, social networking activities and similar data. When gathered, this data, if used, is used in the aggregate, and not in a manner that is intended to identify you personally. This type of aggregate information may be shared with third parties at any time. In addition to the third-party tracking services mentioned above, we also collect this information through various other means, including "cookies” and IP addresses as further explained below. Cookies are dealt with separately see below.

IP Addresses - When you visit and interact with the Website, we or third parties with whom we have contracted to provide services for us may collect Internet Protocol addresses (called an "IP Address"), as well as browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and page navigation. An IP Address is a unique identifier number that certain electronic devices use to identify and to communicate with each other on the Internet; your Internet Service Provider automatically assigns an IP Address to the computer that you are using. We gather this information to track Website visitor movement in the aggregate and to gather broad demographic information for aggregate use. Our goal in gathering this information is to learn how our customers and the public are using our Website. We may use this information to enhance our Website or for other lawful purposes.

Do Not Track - Every time your computer sends or receives information over the Web, the request begins with some short pieces of information called “headers.” These headers include information like what browser you are using, what language your computer is set to, and other details. Consequently, please note that Endo45’s Website does not currently respond to browsers' Do Not Track signals, and as such your activities will be tracked, regardless of whether you have opted to enable the Do Not Track option offered by your browser.

Marketplace information

When we obtain information from you specifically to enable you to buy a service offered on our website or App by some other person, we assume that in giving us your information, you are also giving us permission to pass it to the relevant person like Apple and Google (Android) to procure the item or software.

Your domain name and e-mail address

This information is recognised by our servers and the pages that you visit are recorded. We shall not under any circumstances, divulge your e-mail address to any person who is not an employee or contractor of ours and who does not need to know, either generally or specifically. This information is used:

  1. to correspond with you or deal with you as you expect;
  2. in a collective way not referable to any particular individual, for the purpose of quality control and improvement of our App and website;
  3. to send you news about the services to which you have signed up;
  4. to tell you about our other services or services of sister websites.

Information you post on our website

Information you send to us by feedback, posting to a forum or blog or in your advertisement, is stored on our servers. We do not specifically use that information except to allow it to be read, but you will see in our terms and conditions that we reserve a right to use it in any way we decide including promotion of the App and website.

Website usage information

You may freely visit our Website anonymously and without being required to provide us with any personal information. However, certain requests and features do require that you provide us with some personally identifying information as more particularly described below. Personal information is data that can be used to identify or contact you. Please do not send confidential information to us directly through this Website, or by email to any of the contact email addresses listed on this Website.

We may use software embedded in our website (such as JavaScript) to collect information about pages you view and how you have reached them, what you do when you visit a page, the length of time you remain on the page, and how we perform in providing content to you. We do not presently associate such information with an identifiable person.

Financial information relating to your credit cards

This information is never taken by us either through our website or App download or otherwise. At the point of subscription or payment, you are transferred to a secure page on the AppStore or Google Console or if through the website a reputable payment service provider like PayPal in the future. That page may be dressed in our “livery”, but it is not controlled by us. Our staff and contractors never have access to it.

Support Endo45 “Donations”

To grow the offering and further support people suffering with endometriosis, Endo45 offers for people, companies or other entities to support our cause. So we can continue to reach more sufferers. In time this will be affiliated with a not-for-profit arm of the business that will help people who can’t afford support for the disease directly.

Endo45 respects the privacy of all donors. We believe in safeguarding personal information and ensuring that donor privacy is protected. Your name, address, and any other personal data you provide will be used only by Endo45 to keep you informed of our activities including our programs, special events, and funding needs. If at any time you choose not to receive these communications, you may contact Endo45 and we will gladly remove your name from our mailing list.

Endo45 may publish donors in various Endo45 event programs throughout the year and on our website. We deeply appreciate all donations and equally respect all donor requests to remain anonymous.

If you make a donation via the “Support Endo45” button, you will be given the Endo45 bank account details and can direct transfer money to Endo45.

In the future if you make a donation via the “Support Endo45” button you will be asked to provide certain personally identifying information, such as your name and address, as well as your credit card billing information, in order to process the donation. The credit card information that you provide at the time of donation is used only to process your donation and will not be stored or used for any other purpose. However, if you opt to make a recurring donation, your credit card information will be stored and used for the purpose of processing your recurring donation.

You will be transferred to a secure page with a reputable payment service provider like PayPal etc. That page may be dressed in our “livery”, but it is not controlled by us. Our staff and contractors never have access to it.

  1. Electronic Personal Records - Donor information is maintained in a secured database, and only authorized personnel have access to this information and only for appropriate business purposes.
  2. Mailing Lists - Endo45 does not rent, sell, give away, or trade its donor lists or any information contained on those lists. Donor information is used by Endo45 for charitable purposes only as described above and will not be used by any entity outside of Endo45.   3. Authorized Release of Information - Endo45 may be legally required to disclose information on occasion. Endo45 complies with all applicable legal requirements and standards.

Note on padlock symbols and other trust marks

Many companies offer certification and an icon or other small graphic to prove to website visitors that the website is safe. Some certify to a high level of safety. Others are more concerned to take our money than to provide a useful service. We do not handle information about your credit card so do not subscribe to any such service. Our services are managed by Google and Apple Pay stores.

Credit reference

To assist in combating fraud, we share information with credit reference agencies, so far as it relates to clients or customers who instruct their credit card issuer to cancel payment to us without having first completed the transaction or provided an acceptable reason to us and given us the opportunity to refund their money.

Third-party advertising

Third parties may advertise on our website. In doing so, those parties, their agents or other companies working for them may use technology that automatically collects your IP address when they send an advertisement that appears on our website to your browser. They may also use other technology such as cookies or JavaScript to personalise the content of, and to measure the performance of their adverts. We do not have control over these technologies or the data that these parties obtain.

  3. additional websites on which you can purchase items (supplements, tens machines, tests etc.), gifts, learn more detailed information and connect you to the wider endometriosis ecosystem in support of Endo45.

Please note that we have no affiliation with any of these other parties and/or websites, and cannot control and are not responsible for the information collection, use, and disclosure practices of such third parties; we encourage you to review and understand their privacy practices and policies, if any, before using providing any personally identifying information to them or initiating any financial transactions. We are not responsible for the content or information of these websites, or any other use of the linked website.

Third-party content

Our website may from time to time publish feedback and other information received from users and as such is a publishing medium in that anyone may register and then publish information about himself or some other person. We do not moderate or control what is posted. If you complain about any of the content on our website, we shall investigate your complaint. If we feel, it may be justified, we shall remove it while we investigate.

Free speech is a fundamental right, so we have to make a judgment as to whose right will be obstructed: yours, or that of the person who posted the content which offends you. If we think, your complaint is vexatious or without any basis, we may remove it and we shall not correspond with you about it.

Information we obtain from third parties

Although we do not disclose your personal information to any third party (except as set out in this notice), we do receive data which is indirectly made up from your personal information, from software services such as Google and Apple Analytics and others. No such information is identifiable to you.

Content you provide to us with a view to be used by third-party

If you provide information to us with a view to it being read, copied, downloaded, or used by other people, we accept no responsibility for what that third party may do with it. It is up to you to satisfy yourself about the privacy level of every person who might see your information. If it is available to the World, neither we nor you have any control whatsoever as to how it is used.

Cookies

  8. to record your activity during a webcast. An example is as to whether you have asked a question or provided an opinion by ticking a box. This information is retained so that we can serve your information to you when you return to the website. This cookie will record an anonymous ID for each user, but it will not use the information for any other purpose. This cookie will last for three months, when it will be deleted automatically.
  9. to store your personal information so that you do not have to provide it afresh when you visit the website next time. This cookie will last for 90 days.
  10. to enable you to watch videos we have placed on YouTube, TikTok, InstaGram etc. YouTube will not store personally identifiable cookie information when you use YouTube’s privacy-enhanced mode. These settings are controlled by you on your device and Endo45 takes no responsibility for any information collected by other applications on your device.

Calling our helpline

When you call our helpline, we collect Calling Line Identification (CLI) information. We use this information to help improve the efficiency and effectiveness of our help line.

Sending a message to our support system

When you send a message, we collect the data you have given to us in that message in order to obtain confirmation that you are entitled to receive the information and to provide to you the information you need. We record your request and our reply in order to increase the efficiency of our business / organisation.

If we reply to your request for support via email as requested by you then your email address and personal information sent will be recorded in our mail server.

Complaining

When we receive a complaint, we record all the information you have given to us. We use that information to resolve your complaint. If your complaint reasonably requires us to contact some other person, we may decide to give to that other person some of the information contained in your complaint. We do this as infrequently as possible, but it is a matter for our sole discretion as to whether we do give information, and if we do, what that information is.

We may also compile statistics showing information obtained from this source to assess the level of service we provide, but not in a way that could identify you or any other person.

Job application and employment

If you send us information in connection with a job application, we may keep it for up to three years in case we decide to contact you at a later date.

If we employ you, we collect information about you and your work from time to time throughout the period of your employment. This information will be used only for purposes directly relevant to your employment. After your employment has ended, we will keep your file for seven years before destroying or deleting it according to New Zealand tax law requirements.

Marketing information

Re-marketing

We may use re-marketing from time to time. This involves Google or some other supplier placing a tag or marker on our website in order to be able to serve to you an advert for our products / services when you visit some other website.

Affiliate information

This is information given to us by you in your capacity as an affiliate of us or a customer or client of ours or affiliate to our App. Such information is retained for business use only. We undertake to preserve the confidentiality of the information and of the terms of our relationship. It is not used for any other purpose. We expect any affiliate to agree to reciprocate this policy. As an exception to this, we have the right to disclose your first name and URL of your affiliate connection to other affiliates and to any other person or organisation, on and off the website. The reason is solely to enable us to mention winners and others whose performance as an affiliate is in some way outstanding.

Use of the App and website by children

We do not market to children, nor do we sell products or services for purchase by children. We do sell products and services for end use by children as children also suffer from endometriosis, but strictly for purchase by adults. If you are under 18, you may use our website and App only with consent from a parent or guardian and additional requirements prevail in the EU, Switzerland and United Kingdom as per below.

Endometriosis has been found in children as young as 13 years of age and as such the App and website have been designed to help all sufferers of the disease. However due to the medical nature of Endo45 all users under the age of 18 require parental or guardian approval to use the App and website.

The Website and App does not intentionally or knowingly collect, use, or disclose personally identifiable information about visitors to our Website or download the App that are less than 18 years of age. If a child under the age of 18 submits information to us through any part of the Website or App and Endo45 becomes aware that the user submitting the information is under the age of 18, the information provided will not be stored and will be deleted (including the account) as soon as it is discovered and not used for any purpose. If you are the parent or guardian of a child under 18 years of age and believe that they have disclosed personally identifiable information to us, please contact us at [email protected] and be sure to include in your message, the same user name and password and/or email address that you believe your child submitted.

Please note, if you reside in the European Economic Area, Switzerland And UK, users must be 16 years of age or older, and any registration by, use of or access to the Website by anyone under 16 is unauthorized, as further clarified below.

EUROPEAN UNION AREA, SWITZERLAND AND UNITED KINGDOM USERS

The following provisions apply only to users residing in the European Union Area (“EEA”), Switzerland and the UK.

Endo45 will process personal data that we receive from EU Users on the ground that it is in our legitimate interest for the effective administration of the Website and App, to fulfil and/or address your requests, or to provide the functionalities and features as further described herein.

YOUR INFORMATION AND YOUR CHOICES; WITHDRAWAL OF CONSENT

GDPR provides EU Users with additional rights in respect to the Personal Data we hold about you, including the right

  1. to be informed about the Personal Data we have collected, and
  2. to request a copy of the Personal Data, and
  3. to have your Personal Data deleted, and
  4. to lodge a complaint about our processing of your Personal Data with your local supervisory authority.

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children's Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States' consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

Endo45 does not specifically market to children under the age of 18 years old and endometriosis is not known to commonly occur in children under the age of 13 years.

We collect data about all users of and visitors to the App and website regardless of age, and we anticipate that some of those users and visitors will be children.

Such child users and visitors will inevitably visit other parts of the website or App and will be subject to whatever on-site marketing they find, wherever they visit.

Disclosure to Government and their agencies

We are subject to the law like everyone else. We may be required to give information to legal authorities if they so request or if they have the proper authorisation such as a search warrant or court order.

Compliance with the law

This privacy policy has been compiled so as to comply with the law of every jurisdiction in which we aim to do business. If you think it fails to satisfy the law of your country, we would like to hear from you, but ultimately it is your choice as to whether you wish to use our website or App.

Review or update personally identifiable information

At any time you may review or update the personally identifiable information that we hold about you. Upon appropriate formal request we will update or amend your Personal Data, but we reserve the right to use any information previously obtained to verify your identity or take other actions that we believe are appropriate and lawful. You may access, correct, or request deletion of your Personal Data – or request that we stop any processing of your Personal Data - by contacting us at the address listed above. We will respond to your request within a reasonable timeframe.

Please note we may need to retain certain information for record keeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed from such locations. Additionally, there may be circumstances in which we are not legally required to comply with your request because of the laws in your jurisdiction or because of exemptions provided in data protection legislation in general, and GDPR in particular. Finally, please note that we are not responsible for removing or deleting information from the databases of third parties (such as service providers) with whom we have shared information about you, but we will make the request on your behalf for such removal/deletion.

Removal of your information

Our processing of your personal data is done with your written consent made by agreeing to the Terms of Service and this Privacy Policy upon utilizing peer support services, subscription to our App, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the website, or use certain other site features. By giving us your consent, you also have the right to withdraw your consent at any time to prevent future processing of your personal data.

Subject Access Requests

As a data subject, you are entitled to make a formal request for information we hold about you. Our website is hosted in New Zealand. We also use outsourced services in countries outside New Zealand from time to time in other aspects of our business. Specifically, our technical centre is based in India. Accordingly data obtained within New Zealand may be “processed” outside New Zealand and data obtained in any other country may be processed within or outside that country.

Use of the Website and App outside of New Zealand

We do not represent or warrant that the Website or App, or any part thereof, is appropriate or available for use in any particular geographic location. If you choose to access our Website, you do so on your own initiative and at your own risk and are responsible for complying with all local laws, rules, and regulations applicable in your jurisdiction. Please note that the Website and App is hosted in New Zealand and is governed by New Zealand law. If you are visiting the Website from outside New Zealand, please be aware that your information will be transferred to, stored and processed in New Zealand and possibly India where our support teams are located, some of our databases are hosted in the United States of America. The data protection and other laws of New Zealand and other countries might not be as comprehensive as those in your country. Data Breaches - Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

  1. We will notify you via email within 7 business days of Endo45 becoming aware of the data breach

Email Messaging - CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them.

We collect your email address in order to:

  1. Send information, respond to inquiries, and/or other requests or questions
  2. Process orders and to send information and updates pertaining to orders.
  3. Send you additional information related to your product and/or service
  4. Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CANSPAM, we agree to the following:

  1. Not use false or misleading subjects or email addresses.
  2. Identify the message as an advertisement in some reasonable way.
  3. Include the physical address of our business or site headquarters.
  4. Monitor third-party email marketing services for compliance, if one is used.
